Kuzminski Loses in Court

Fresh when it gets here from Julie Barrett

This is a case I've been following for a while, but I don't think I've blogged about. Almost a year ago David Kuzminski of Preditors and Editors was sued for defamation. The person who filed the suit is Victor C. Cretella III, who is legal counsel for PublishAmerica. I'm not going to get into the specifics, but you can read about it at the Citizen Media Law Project.

As far as I can tell, this is a personal suit, separate from PublishAmerica. That's worth noting.

Kuzminski lost in court yesterday, but the avenue is open for an appeal.

I'm not a lawyer, and further, I don't think it's a good idea for either party involved to discuss the specifics of the case other than what's in court documents. I'm certainly not going to offer an opinion on the verdict because I'm not qualified to do so. However, Kuzminski represented himself, and to this layperson that put him at a disadvantage. There's a legal fund to help him with his appeal. If you're interested in kicking in a couple of bucks you may do so through the P&E site. Scroll down for the button.

For those of you following such things, this is separate from the Barbara Bauer case, which is still winding its way through court, apparently.

Anyway, I just hate to see the guy go into court without representation. He may still lose his appeal, but at least he'll have representation.
