A Wordy Issue
Yes, words do matter, particularly for the applicant for a trademark for a rooster-shaped lollipop. While you consider the culinary merits of such a confection, do ponder on the implications of a name.

Ah, yes.

And it's no wonder the US patent and Trademark office denied an application to trademark the term...

Kuzminski Loses in Court
This is a case I've been following for a while, but I don't think I've blogged about. Almost a year ago David Kuzminski of Preditors and Editors was sued for defamation. The person who filed the suit is Victor C. Cretella III, who is legal counsel for PublishAmerica. I'm not going to get into the specifics, but you can read about it at the Citizen Media Law Project.

As far as I can tell, this is a personal suit, separa

Harry Potter and the Lingering Legal Opinion
Or something like that.

A judge has ruled in favor of J. K. Rowling in her suit to bar publication of The Harry Potter Lexicon. IP attorney C. E. Petit has an explanation of some points of the ruling in his blog.

I'm still in the "if you're going to make money off of

Some Good Advice for Bloggers
Via Photo Attorney comes this interview with attorney Ron Coleman on legal issues for bloggers.

I feel obligated to mention that while the link goes to a conservative political site, the article itself is very non-political. Instead, it talks about things bloggers need to be aware of, particularly when quoting from other a

Speaking of free speech...
Here's the Author Advocate Defense Fund, set up to help pay legal expenses for the folks who have been sued by Barbara Bauer.

Just so you can see what the suit is about, here's a link to the documents available at the EFF. They were defending Wikimedia (parent of Wikipedia), which was dismissed from the suit the other day. If you feel like slogging through the 35-page c

Lawsuit against Wikimedia Foundation tossed
According to Wikinews and The Asbury Park Press, a judge has dismissed the defamation suit against Wikipedia's parent organization the Wikimedia Foundation by literary agent Barbara Bauer.

This ruling only affects Wikipedia, and not the complaints against the other defendants.

Catching up on some writing/publishing news

The other day I saw a tweet from Allena Tapia, who writes the freelance writing column at about.com asking about whether or not a blogging opportunity was legit. The site is today.com, which apparently has been offering free blogging space for some time. Recently they initiated a VIP blogger program which promises payment.

The bottom line is that the site is very new and it's difficult to say...

Court Rejects Wal-Mart's Trademark Claim

In a victory for free speech advocates, a court ruled that using Wal-Mart's smiley face on a parody site is not trademark infringement.

Parody is still free speech. Woot!

This 'n That

Feeling better today, but still trying to take it sort of easy. I'm just going to catch up on a few items:

  • After Tuesday's rant about my problems with Sprint I see this Business Week web section on customer service. Read Sprint's Wake-Up Call and peruse some of the comments. Wow. I'm glad to see that an effort to improve customer service is under way, but they need to do something now to sto...
